Frequently asked questions
Is POPIA compliance really required for small businesses?
Yes. POPIA applies to any business that processes personal information, which includes a customer list or employee records. Size does not exempt you; the Information Regulator can fine or issue enforcement notices against businesses of any size.
What documents do I need to be POPIA compliant?
At minimum: a privacy policy, a PAIA manual, consent wording where you collect data, a breach response procedure, and agreements with anyone who processes data for you. Those five are exactly what this pack covers.
Do I need to register an information officer with the Information Regulator?
Every business has an information officer by default, usually the owner or CEO. Registration on the Regulator portal is expected before the officer performs their duties, and the pack includes the step by step registration guide.
What is the penalty for not complying with POPIA?
The Regulator can issue enforcement notices, and offences can carry fines up to R10 million or imprisonment in serious cases. The more common cost is a complaint or breach you cannot answer because nothing was documented.
