Turnover between R10 million and R50 million? You are a Qualifying Small Enterprise, and the affidavit route only remains available if you are at least 51 percent black owned; otherwise a verification agency is required. Above R50 million, verification is always required.

Frequently asked questions

Do I need a B-BBEE certificate if my turnover is under R10 million?

No. A business with annual turnover of R10 million or less is an Exempted Micro Enterprise and only needs this sworn affidavit, which is free. Paying an agency for an EME is paying for something the law gives you at no charge.

What level does an EME get?

Level 4 automatically; Level 2 at 51 percent or more black ownership; Level 1 at 100 percent. The affidavit states the turnover and ownership facts under oath.

Where do I get it sworn?

Any commissioner of oaths: every police station does it free, and many banks, attorneys and post offices have commissioners. It is only valid once signed, stamped and dated before the commissioner.

How long is it valid?

Twelve months from the date of commissioning. Tenders check the date; an expired affidavit counts as none at all.
