What transfer duty is - and what it is not
Transfer duty is SARS's tax on acquiring property, on a sliding table starting at zero below R1 210 000 and reaching 13% on the portion above R13,31 million. It is separate from the conveyancer's professional fees, bond registration costs and the deeds office levy - budget for those on top.
One big exception: if the seller is a VAT vendor selling in the course of their business (a developer selling new units, for example), the sale attracts VAT instead and no transfer duty is payable. The price then usually includes the VAT.
Frequently asked questions
Who pays the transfer duty - buyer or seller?
The buyer, via the conveyancer, before the deeds office will register the transfer. SARS issues a receipt the registration cannot happen without.
Does a company or trust pay a different rate?
No - since 2016 natural persons, companies and trusts all pay the same table.
When is it due?
Within six months of the transaction date. Late payment attracts interest, which the conveyancer will collect from you.
Can your salary carry the bond?
